TEACHING CORPORATE LAW: A RESPONSE TO THT CHALLENGES LEGAL MARKET

Abstract

It is noted that the full-scale military invasion of russia into Ukraine and the acceleration of the process of joining the European Union have created new challenges and problems in all spheres of its social life. It has been found that in the field of legal education they relate primarily to the insufficient level of training of lawyers and require a timely response by improving the teaching of academic disciplines in the specialty of law, including the course of corporate law. It has been proven that the strategic direction of improving the quality of the educational process, which meets international, including European, standards for training legal specialists, is the improvement of educational programs. The current requirements of employers for graduates of higher education institutions in the field of law are determined and directions for improving the quality of their training, in particular in the field of corporate relations, are proposed. It is noted that improving the training of future lawyers, including in the field of corporate law, should be carried out on the basis of modernization of educational and interdisciplinary programs in accordance with European standards of higher legal education. It is revealed that the content of the specified standards provides for the modernization of educational programs by including legal ethics, practical training, studying EU law, participation in international academic mobility, etc. The world experience of legal education with the use of innovative technologies is analysed. The relevance of harmonizing Ukrainian legislation with European law in various branches of law is clarified. It is established that from the standpoint of the need to attract foreign investment to the Ukrainian economy, its adaptation to the EU acquis communautaire law in the field of corporate legal relations is of great importance. It is noted that their entities (limited liability companies, business partnerships, transnational corporations, holding companies, conglomerates, etc.) play a decisive role in the economies of developed countries. It is found that this is due, in particular, to the fact that the value of the assets of some transnational corporations is greater than the gross domestic product of individual states. The need to adopt a Commercial Code of Ukraine similar to those in force in the EU countries, instead of the abolished Commercial Code, in which a separate section should provide for the regulation of corporate legal relations, is noted.
