CONSTITUTIONAL CONTINUITY IN THE XIX CENTURY IN UKRAINE: HISTORICAL AND THEORETICAL ASPECT

Abstract

The article examines the processes of constitutional development in Ukraine in the 19th century through the prism of the continuity of legal traditions and institutions. After all, the topic of constitutional continuity in Ukraine during this period is important for understanding the evolution of the legal foundations of statehood and their connection with national identity. The impact of the views of such Ukrainian thinkers of the 19th century as Mykola Kostomarov, George Andruzkyi, Serhiy Podolinskyi, Mykhailo Drahomanov and Yulian Bachynskyi on autonomy, independence, the rule of law and civil liberties is analyzed, as well as the best samples of documents, which, in general, by their content, ideological and legal content, and other qualitative characteristics reveal the main aspects and features of the evolution of the development of state-political views and constitutional ideas. In the context of the historical-theoretical approach, an analysis of the influence of constitutional traditions, which were formed in previous historical periods and under the conditions of the imperial regime, on further legal processes in Ukraine was carried out. The importance of European ideals of law and constitutional practices in shaping the views of Ukrainian thinkers is revealed. Separate attention is paid to the theoretical understanding of the connection between historical events and the development of constitutional concepts, in particular in the context of human rights and freedoms, national identity and autonomy. It is indicated that the constitutional continuity in Ukraine of the 19th century reflects the gradual evolution of state-legal views, where there is a gradual transition from autonomist ideas to national selfdetermination. The article emphasizes the importance of the durability of these ideas, which ensured logical continuity in the process of creating its own national democratic-legal state, independent of empires. It is emphasized that despite political restrictions, these ideas became the basis for the further development of constitutional processes in Ukraine.
