LIABILITY OF LEGAL ENTITIES FOR ENVIRONMENTAL OFFENSES IN THE EU DIRECTIVE ON THE PROTECTION OF THE ENVIRONMENT THROUGH CRIMINAL LAW

The article examines the provisions of Directive (EU) 2024/1203 of the European Parliament and of the Council on the protection of the environment through criminal law, which replaces Directives 2008/99/ EC and 2009/123/EC (the Directive), relating to the liability of legal entities. A comparative analysis is conducted between the provisions of this international legal instrument and the Ukrainian model of criminal law measures against legal entities.
Referring to the works of foreign researchers, the article identifies the advantages of criminal liability of legal entities for environmental delicts over other types of liability. Using the high-profile case of the car manufacturer Volkswagen – which became one of the driving forces behind the development and adoption of the Directive – as an example, the effectiveness of autonomous criminal prosecution of legal entities for violations of environmental legislation is demonstrated. It is established that, given the lack of a unified approach at the European level regarding the nature of corporate criminal liability, the drafters of the Directive embrace a pragmatic pluralism in terms of the type of liability applicable to legal entities for environmental criminal offenses, leaving this issue to the discretion of national legislatures. At the same time, the Directive reflects the model of autonomous corporate criminal liability; its introduction marks a new, more effective approach to criminal law protection of the environment at the EU level.
The article identifies similarities between Ukraine’s domestic additional (non-financial) criminal law measures against legal entities and the measures listed in Article 7 of the Directive that may be applied to legal persons. A critical assessment is given of the provisions in Chapter XIV-1 of the General Part of the Criminal Code of Ukraine, particularly: (a) the fragmented (selective) approach to addressing corporate criminal liability with respect to the list of criminal offenses; (b) certain aspects of the procedure for applying criminal law measures to legal entities. The author substantiates the need to expand the grounds for applying criminal law measures against legal entities to include environmental criminal offenses committed on behalf of and/or in the interest of a legal entity.
