CUSTODY RECORDS AS A TOOL FOR ENSURING HUMAN RIGHTS IN THE ADMINISTRATIVE ACTIVITY OF THE POLICE: HISTORY AND CURRENT STATE OF IMPLEMENTATION

The article conducted a comprehensive analysis of the process of implementation of the Custody Records project in the National Police of Ukraine. Key organizational-legal and technical problems are defined that hold back its effective implementation. Scientificly substantiated proposals for improving regulatory regulation, functional characteristics of the system and ensuring observance of human rights in temporary detention center are formulated. It is established that in 2017 the Custody Records project as of 2025 is at the stage of implementation. It is emphasized that the electronic system of fixing actions on detained persons, primarily developed for temporary detention facilities, was transformed into the information subsystem of the information and communication system “Information Portal of the National Police of Ukraine”. It is proved that the pace of implementation of the project is largely dependent on the availability of external financing by international partners (EU advisory mission in Ukraine, the International Renaissance Foundation, the Expert Center for Human Rights, the Ukrainian Legal Aid Foundation, etc.), as well as on the administrative initiative of the Ministry of Internal Affairs of Ukraine.It is emphasized that, despite the legislative changes, a number of key aspects of the Custody Records system continue to remain out of proper legal regulation. The need for development and approval is substantiated: the Regulations on the organization of work of police officers responsible for the observance of the rights of detained persons in the police units; Technical requirements for the operation of specialized rooms for interview with detained persons. The legal framework for the functioning of the Custody Records system is analyzed, which will properly provide a positive impact on the effectiveness of the further implementation of Custody Records, increasing the level of guarantees of the rights of detained persons and consolidating the mechanisms of internal and external control in the police.
